We may change these Terms at our sole discretion at any time. You are responsible for regularly reviewing these Terms to ensure your continued compliance with them.

These Terms do not affect your statutory rights.

1. “Order” means a purchase order issued by you to Us (either online, by telephone or in writing) for Products in accordance with these Terms

2. “Products” means the goods supplied on this website in accordance with these Terms

3. “Buyer” means the party contracting with Us to buy Products in accordance with these Terms

4. “You” means any person using this website including a Buyer

6. Any content viewed or downloaded from this site is for your personal use only and any content on this site may only be viewed, downloaded or printed as a Buyer or potential Buyer from Us

7. You may not modify, publish, reproduce, distribute or broadcast any of the material found on this website in any format

8. We may discontinue the website or any Product offered on the website at any time and at our sole discretion

9. We may restrict your access to the website or parts of the website at any time without notice or liability

3. Your Account

1. You must keep your login and password information secure and use this to access your account details

2. You must notify Us immediately if You believe your account information has been compromised without your authority

3. You are responsible for all activity on your account

4. You are responsible for ensuring that the details for your account are accurate and complete

5. You must notify Us immediately of any changes in details relating to your account

6. You are able to amend your personal details when You log into your account

7. In order to purchase products from Beloved Bespoke and/or access the ‘my account’ section of the website, You must provide your personal details when registering, including your email address, postal address and telephone number

8. In order to purchase products from Beloved Bespoke and/or access the ‘my account’ section of the website, You must be 16 years of age or older

9. The postal address provided must be the same as that of any credit or debit card used to purchase Products on the Beloved Bespoke website

4. Products

1. All designs, images, descriptions, specifications and advertising on this website are issued or published by Us for the sole purpose of giving an approximate idea of the Product described. The images are computer generated to give an approximate idea of the Product rather than an exact depiction.

2. We not guarantee nor do We warrant (to the extent permitted by law) in any way that the information on this website, including but not limited to images, descriptions, depictions of materials and colours is up-to-date, complete, accurate, reliable or error-free

3. The colour of images on this website may be limited by the availability of images, colours or shades, or by the technology You use to access this website, of the screen on which you view this website. Although we aim to provide an accurate representation of the Product being designed, we cannot guarantee that any Products will look the same on every monitor you use

4. The Products on this website are hand finished to your specific design. You are buying a unique item and the colours, textures and finishes may vary slightly

5. If a personalized engraving appears on your Product, We do not guarantee to honour your design. If your engraving contains the name of a brand, celebrity or other material that We, in our sole opinion, consider inappropriate and do not wish to place on our Products, your Order will be rejected either immediately or at a later stage.

6. You are solely responsible for the design of your bespoke Product. Whilst we have the right to decline your design, we have no obligation to review or decline any design#

7. The design of your item and any engraving on your item shall be created by yourself, or, to the extent that this is not the case, you guarantee that you are authorized to use the design or wording created by someone else

8. You hereby agree that you will have no (intellectual property) rights over the design of your Product, To the extent that any intellectual property rights would be applicable to your design or engraving, these rights shall vest with Beloved Bespoke Limited. By submitting an design to Us, you grant Us an exclusive, fully paid, royalty free licence to use your design for whatever purpose We see fit.

5. Pricing

1. The pricing of Products on the Beloved Bespoke website is derived from the market value of the precious metals and gemstones utilised. We do not accept any liability for the accuracy of these prices or availability of pricing for any Product.

2. The price You must pay for your Products is the price shown in your basket when You confirm your Order, unless there has been an error in the price. If there has been a pricing error, You will be contacted at the earliest possible opportunity and given the opportunity to re-confirm your Order at the correct price. If You cannot be contacted, your Order will be cancelled.

3. We endeavor to keep the prices on the website constant for as long as possible. However, precious metals and gemstones valuations are subject to market fluctuations. The prices on the website are subject to change and We reserve the right to change prices without notice. The price displayed at the moment of Order is the price applicable to that Order.

4. Although the pricing in the website is calculated with care, it is possible that the pricing information on the website contains errors. We are not bound by our offer and we reserve the right to cancel your purchase in the event of such an error.

6. Order Placement

1. When You place an order with Us, you are offering to buy the Products You Order. This does not reflect a commitment for Us to accept the Order.

2. When You check out online, You will receive an email to confirm that We have received your Order. This does not mean your Order has been accepted and there is no legally binding contract at this stage.

3. By placing your order, You confirm that the details contained in the Order are correct are all correct in accordance with the confirmation screen

4. When You order online, an email confirmation will be automatically be sent to the email address which You have provided. It is your duty to ensure that the email address provided is correct. If You have not received email confirmation of an Order within one hour of placing your Order, We recommend that You contact customer services.

5. Once We have received cleared funds for the full value of your Order, reviewed the details of your Order, We will email You with confirmation that your Order has been accepted, at which point a there is a binding contract.

6. All Orders are subject to verification and receipt of payment

7. Should We be unable to fulfill an Order due to any technical issues with the specifications of the ring you have designed, You will be contacted by customer services and given the option to accept an adapted design, or cancel your Order. If We are unable to contact You, your Order will be cancelled

8. Orders may be placed on the website, as designs cannot be accurately described over the telephone

9. We explicitly reserve the right not to accept your Order, or to cancel Your Order for any reason after the automated Order confirmation has been sent

7. Payment

1. Payments may be made by credit or debit card and will be accepted through the secure payment gateway on the website

2. For initial orders, in order to protect both You and Us from fraudulent activity, the billing address for the credit or debit card used for payment must be the same as the delivery address to which the Order is to be dispatched

8. Delivery

1. Delivery must be made to the card holder address for Products paid for by credit or debit card

2. No deliveries will be made to PO boxes

3. The delivery fee for fully insured delivery of your Products will be shown clearly at the point of checkout.

4. Delivery times stated are estimates only

5. We aim to deliver Products within 28 days of your Order. We require this time because the Products on this site are bespoke and need to be individually manufactured and finished to your specifications. We will deliver within this timeframe to the extent that this is commercially reasonable, but cannot guarantee timely delivery.

6. We may deliver Products in installments at our discretion; each installment will be treated as a separate contract. This will not affect the fee charged for delivery, which will remain as shown at the point of checkout.

7. Products are at risk from the point of delivery. We require You to inspect the Products upon delivery to ensure that they are present and as ordered and You will in any case be deemed to have done so. All Orders are checked before dispatch and once delivered and signed for, We accept no further liability.

8. Products are delivered by Royal Mail and will be delivered to the address supplied and a signatory at that address whose name is not printed on the parcel may be accepted. Delivery will be deemed completed once Royal Mail collects a signature at the delivery address and it is your responsibility to ensure that the parcel is signed for by an authorized person. We advise that You be present at the registered address to receive your parcel.

9. Parcels will not be left without a signature. If for any reason your parcel is undeliverable, it will eventually be returned to Us and you will be liable for the return cost and any additional postage.

10. Ownership of the Products purchased on the website will pass to You upon delivery, provided that We have received payment in full for the Products.

11. We will not be held responsible for any redirected items.

12. We will not be held responsible for any delays caused by third parties or factors beyond our direct control

13. Our liability for non-delivery of any Products shall be limited to replacing the Products within a reasonable time or issuing a credit note or voucher against any invoice raised, or payment made, in respect if such products, and will be subject to Us having received written notice if the non-delivery within seven working days of the date when Products would or should, in the ordinary course of events, have been received by you.

9. Cancellation & Returns

1. All the Products supplied by Beloved Bespoke are subject to fluctuations in the financial markets, which cannot be controlled by Us .Also, the products on this site are bespoke and made specifically to your design. Consequently the right to cancel under the Consumer Protection (Distance Selling) Regulations 2000 does not apply to transactions on this website

2. Once an order has been placed, the process of manufacturing your product will begin almost immediately. Consequently, once an order has been placed, it cannot be cancelled.

3. If you have made a mistake on your order, please contact us as soon as possible and we will endeavor (but do not guarantee) to make any necessary changes to your order

4. Products are classified as faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of wear and tear are not considered to be faulty.

5. If You believe, on receipt, that your Products are faulty due to manufacturing fault, You must contact Us within seven working days of delivery and We will do our best to help You. We reserve the right to use our discretion when deciding whether to replace or repair faulty or damaged Products. This does not affect your statutory rights.

6. If You believe that your Products are faulty due to a manufacturing fault, You must only return them once you have Contacted Us. Once you have contacted Us to inform us of the problem, you must return your Products as instructed within fourteen days

7. Products must be returned using a fully insured signed-for delivery service, such as Royal Mail’s Special Delivery Service. You must retain proof of postage, as we do not accept any liability for returned Products until they have been received and signed for by Us.

8. If, upon receipt, you find You have made an error with the design of your Product (such as a finger sizing error or engraving error) please contact Us. Whilst We accept no liability whatsoever for such errors, it is very important to Us that You are happy with your Product. Consequently, where reasonably and economically viable, We may, at our sole discretion, attempt to resolve any problems either free of charge or on an ‘at cost’ basis.

10. Warranties & Liabilities

1. We warrant that the Products comply in material respects with their description on our website and are free from material defect at the time of delivery. We do not make any other warranties about the Products.

2. If You believe We have delivered Products which are defective in material or workmanship, following our investigations, and You have complied with our Terms, We will (at our option) replace the Products or refund the price

3. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or fraudulent misrepresentation

4. In the absence of negligence, your use of the Products is entirely at your own risk

5. You will be responsible for all liabilities, claims and expenses that arise out of the content You submit, post or transmit via the website or the misuse by any person for whom You are responsible or from your violation of the terms

6. We cannot assume any liability from;

   1. Any viruses or other disabling features that affect your access to the website

   2. Any incompatibility between the website and any other hardware, software or websites

   3. Any discontinuance, or change to the website

7. If either You or We are in breach of these terms, neither of shall be liable for any losses that the other suffers as a result, except those which are a foreseeable consequence of the breach. Any losses which could have reasonably been contemplated by both parties at the time You place the order shall be regarded as foreseeable.

8. Beloved Bespoke Limited’s total liability in contract, tort, misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of an order shall be limited to the Order price and We shall not be liable to the Buyer for loss of profit, loss of business, depletion of goodwill, or any consequential claims whether direct or indirect which arise out of or in connection with the Order.

11. Privacy Policy

1. We understand that privacy and security are paramount and all personal information and payment details will be strictly protected in accordance with the Data Protection Act 1998

2. We work to protect the security of your information during transmission using Secure Socket Layer (SSL) software which encrypts the information you send us

3. You agree that we may use Personal Information provided by you in order to conduct appropriate anti-fraud checks for both your and our benefit. This is only done to confirm your identity and prevent fraud and will not affect your credit rating

12. Intellectual Property

1. No licence to use any trade mark of Beloved Bespoke Limited is granted to You in these Terms

2. The content of this website is protected by intellectual property law. You may retrieve and display the content of the website on a computer screen, store such content in electronic form or print a copy of the content for your own personal, non-commercial use provided that any proprietary or copyright notices remain intact. You may not otherwise copy, alter, reproduce, distribute or use for commercial purposes any images, materials or content from the website without the express written permission of Beloved Bespoke Limited.

13. Promotions

1. Beloved Bespoke reserved the right to cancel or change any promotion or discount without notice at any time

2. Promotional Codes should be entered into the ‘Promotional Code’ box in the shopping cart

3. Promotional codes cannot be used in conjunction with any other offer

4. Promotional codes cannot be applied retrospectively to previous orders

5. Promotional codes are valid for one transaction per person

6. There are no cash alternatives to any promotional codes or special offers and all terms and conditions are non-negotiable

14. Gift Cards

1. All gift cards have a 12 month validity period from the date of original issue

2. Any gift card presented for use outside the 12 month expiry date will not be redeemable against a purchase

3. No cash equivalent is available

4. No promotional codes or special offers can be used in conjunction with gift cards

15. Miscellaneous

1. These Terms are governed by English law & shall be subject to the exclusive jurisdiction of English courts

2. If any clause or provision in these Terms is found to be wholly or partially invalid or unenforceable, this shall not affect the validity of the remainder of it

3. We will not be held liable for any failure to deliver Products or perform any other obligation laid out in these Terms if the same is caused directly or indirectly by circumstances outside our control

4. We are not liable for any loss or damage (including any indirect or consequential loss, financial loss, loss of profits or loss of use) associated with the provision of the Products on this site, even if We are negligent

5. A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 199 to enforce any term of these Terms. This clause does not affect any right or remedy of any person which exists or is available otherwise.
